Facilitate reintegration
Swiss and Brazilian prisoners will in future be able to serve the rest of their sentences in their home country. The Federal Council today approved a corresponding international treaty on the transfer of sentenced persons with Brazil.
The bilateral transfer treaty has primarily a humanitarian purpose and aims to facilitate the social reintegration of prisoners after their release. Both states can agree to the execution of a foreign sentence, but are not obliged to transfer a prisoner. The prisoner cannot derive from the treaty a right to serve the remainder of the sentence in the home state. The prerequisite for a transfer is the consent of the sentencing state, the home state, and the sentenced person. In contrast to the Additional Protocol to the European Convention on Transfer, the bilateral treaty does not provide for the possibility of transferring a prisoner to his home country even against his will.
