Ma l'assicurazione infortuni della citt\u00e0 di Zurigo ha rifiutato di pagare le prestazioni.<\/p>\n<p>Come riportato dall'agenzia di stampa SDA, la Corte Suprema Federale ha ora stabilito che questa non deve essere considerata una malattia professionale. Non \u00e8 stato possibile dimostrare l'esistenza di un nesso imprescindibile tra la malattia e l'attivit\u00e0 lavorativa.<\/p>\n<p>I requisiti per provare una malattia professionale sono elevati, come ha affermato il Tribunale federale nella sentenza pubblicata venerd\u00ec. Il motivo \u00e8 l'intenzione del legislatore di non confondere il confine tra malattia e malattia professionale in termini di diritto assicurativo.<\/p>\n<p>Pertanto, \u00e8 necessario che una persona assicurata sia stata esposta a un rischio professionale tipico per un certo periodo di tempo. In ogni singolo caso, si deve dimostrare se l'attivit\u00e0 professionale ha causato la malattia in modo fortemente prevalente o esclusivo.<\/p>\n<p>Nel caso dell'agente di polizia della citt\u00e0 di Zurigo, che era assicurato con l'assicurazione contro gli infortuni della citt\u00e0 di Zurigo, il tribunale cantonale di primo grado \u00e8 giunto comunque alla conclusione che i disturbi psicologici erano una conseguenza delle esperienze del lavoro quotidiano. Pertanto, ha ritenuto che fosse affetto da una malattia professionale.<\/p>\n<p>Il Tribunale federale ha ora annullato questa decisione. La decisione si \u00e8 basata su una perizia della SUVA. L'agente di polizia in questione aveva diversi precedenti che, tra l'altro, risalivano alla sua infanzia.<\/p>\n<p>Non si poteva quindi presumere che almeno il 75% del disturbo da stress fosse stato causato dall'attivit\u00e0 lavorativa.
