Complaint against extradition

One of the seven imprisoned football officials has filed an appeal with the Federal Criminal Court against the extradition warrant issued by the Federal Office of Justice.

On May 27, 2015, seven football officials were arrested in Zurich by order of the Federal Office of Justice (FOJ) and placed in extradition custody. According to the US arrest request, they are suspected of having accepted bribes worth millions.

One of the seven detainees has lodged an appeal with the Federal Criminal Court in Bellinzona against the extradition warrant issued by the Federal Office of Justice. The Federal Criminal Court will decide whether he must remain in custody for the duration of the extradition proceedings. Both the detained person and the Federal Office of Justice can appeal the Federal Criminal Court's decision to the Federal Supreme Court in Lausanne, the FOJ writes.

G7 creates fund for occupational safety

The representatives of the seven largest industrialized nations, who are meeting at the G7 summit in Germany these days, want to take greater responsibility for global production chains.

To this end, they have worked in cooperation with the International Labour Organization ILO launched a global fund, the Vision Zero Fund. This is intended to support companies in complying with standards for occupational safety, social responsibility, working conditions and environmental protection - especially in poorer production countries. For example, investments in occupational health and safety are to be financed, or accident insurance policies are to be set up, as German Labor Minister Andera Nahles explains.

This is intended to prevent tragic accidents in the future, such as the factory collapse of the Rana Plaza in Bangladesh two years ago, in which 1100 workers lost their lives.

The labor and development ministers of the G7 countries will meet in October for their own conference on the subject of fair production in supply chains. The resolutions of the G7 summit are to be implemented there.

To make their employees aware of this, companies can use the new Safety kit "Hazard symbols order from the Swiss Council for Accident Prevention (BFU). The free kits include flyers, posters, protective gloves, presentations and a video.

Fewer criminal convictions among juveniles

For 2014, a downward trend in juvenile adjudications can be observed (a good 12,800 juvenile adjudications; -4% compared to 2013). This writes the according to the Federal Statistical Office.

While juvenile convictions for crimes against the criminal code decreased by 6% and for narcotics use by 1%, trafficking in narcotics recorded an increase of 21%, according to the Federal Statistical Office (FSO).

A total of just over 6,600 juvenile sentences were handed down for an offense under the Criminal Code. This represents a decrease of 6% compared to 2013. The decline is evident both in the quantitatively significant offenses against property (-7%) and in the less frequent violent offenses (-16%).

Adult judgments: stagnation at a high level

In the case of adult convictions, the conviction figures are stagnating at a peak of just over 110,100 convictions according to the new FSO results. Here, the declines in adult convictions under the Criminal Code (-7%) are offset by an increase in road traffic offenses (+6%) and narcotics trafficking (+2%).

For adults, there was a decrease in sentences based on the Criminal Code for 2014 (-7%). In total, just under 36,600 adult sentences were handed down. This trend is very much influenced by convictions for crimes against property - mostly thefts. These account for a good half of all sentences based on the Criminal Code. For theft, the decrease is 14% for 2014, after a total increase of 73% in the previous five years. Both the increase and last year's decrease can be largely attributed to convictions of persons who are not permanent residents of Switzerland (increase of +173% between 2008 and 2013, decrease of -15% between 2013 and 2014).

Time recording at banks to be relaxed

Bank employees with a fixed annual income of CHF 120,000 or more and a high degree of time autonomy are to be allowed to waive the recording of working hours in future. This was announced by the social partners in the banking sector - the Swiss Bank Employees Association (SBPV), the Swiss Commercial Employees Association (Kaufmännischer Verband) and the Swiss Employers' Association (Schweizerischer Arbeitgeberverband).

Employees below the salary threshold, who are largely allowed to set their own working hours, will also be able to record their working hours more easily in future: they will only have to state the hours worked, but not the exact times and breaks.

This agreement is a response to the Compromise proposal in working time recordingwhich the Federal Council announced in mid-February of this year.

The Federal Council has revised the Chemicals Ordinance (ChemO) due to the introduction of the new classification, labeling and packaging system for chemicals. The revision enters into force on July 1, 2015.

The use of the new globally harmonized system for classification and labeling is mandatory for all chemicals manufactured after June 1, 2015. A revision of the ChemO was necessary so that old provisions could be deleted and references to the relevant European law updated.

Within a period of two years, the new hazard symbols (diamonds with a red border) will have completely replaced the old pictograms on an orange background. For plant protection products, the deadline has been set for mid-2018.

Facilitate reintegration

Swiss and Brazilian prisoners will in future be able to serve the rest of their sentences in their home country. The Federal Council today approved a corresponding international treaty on the transfer of sentenced persons with Brazil.

The bilateral transfer treaty has primarily a humanitarian purpose and aims to facilitate the social reintegration of prisoners after their release. Both states can agree to the execution of a foreign sentence, but are not obliged to transfer a prisoner. The prisoner cannot derive from the treaty a right to serve the remainder of the sentence in the home state. The prerequisite for a transfer is the consent of the sentencing state, the home state, and the sentenced person. In contrast to the Additional Protocol to the European Convention on Transfer, the bilateral treaty does not provide for the possibility of transferring a prisoner to his home country even against his will.

NCS implementation on track

The Federal Council has taken note of the 2014 annual report of the Steering Committee on the implementation status of the "National Strategy for the Protection of Switzerland against Cyber Risks (NCS)". The annual report provides an overall view of the implementation work and informs about the achieved goals of the measures.

The 16 measures are to be completed by the end of 2017. Every year, the Steering Committee submits NCS the Federal Council a Report on the progress made.

Important goals achieved, first measures completed

In 2014, the first important goals and milestones were achieved according to plan. Two measures have already been completed: an overview of the relevant legal bases in the cyber area and a concept for management procedures and processes to be used in the event of cyber incidents. Another important success was achieved by establishing the "Swiss Cyber Experts" competence network, a public-private partnership of the federal government and the private sector for cooperation in dealing with serious cyber incidents. Within the Confederation, the newly established Cyber NDB division in the Federal Intelligence Service (FIS) will make it easier to identify perpetrators in the future. In addition, the existing centers of expertise for analyzing malware (CERTs) have increased their readiness and staying power.

Among the measures currently being implemented, it should be noted that some operators of critical infrastructures have carried out risk and vulnerability analyses regarding cyber risks and, based on the results, it has been possible to initiate the conceptualization of continuity management. Likewise, work on the creation of a situation picture is proceeding according to plan. International cooperation at bilateral and multilateral level has also been significantly strengthened, particularly in the context of the confidence-building measures of the OSCE, which Switzerland chaired in 2014.

Effectiveness review in progress 

The activities arising from the NCS to protect against cyber risks must be periodically adapted to the changing threat landscape and also continued beyond 2017. In order to review the effectiveness of the individual measures, a corresponding analysis will be prepared in the course of 2015 and 2016. This is to be presented to the Federal Council in the form of a comprehensive final report in spring 2017.

Decentralized but coordinated NCS implementation

With the NCS, the Federal Council has set three main strategic goals: the early detection of threats and dangers in the cyber domain, increasing the resilience of critical infrastructures and the effective reduction of cyber risks. This results in a broad spectrum of measures, which are processed decentrally by the responsible organizational units. The NCS coordination unit, located at the Reporting and Analysis Centre for Information Assurance (MELANI), coordinates the work at the operational and technical level. Strategic responsibility is borne by the NCS Steering Committee appointed by the Federal Council, which is made up of representatives from all the departments involved. To ensure that implementation proceeds in a coordinated manner and that the strategic goals are achieved on time, the NCS coordination office has defined milestones with the responsible federal agencies and recorded them in a roadmap.

We sit too much

We sit for an average of 4 to 5 hours a day. The Federal Office of Public Health sees this as a cause for concern.

The Federal Office of Public Health warns of the negative effects of sedentary behavior. An hour of the BAG shows that in Switzerland people between 15 and 74 years sit on average 4 to 5 hours a day. Every sixth person even reaches 8.5 hours a day.

This is too much and has negative effects on the entire body. The bad news here is that even if people meet the recommendation of 2.5 hours of moderate exercise per week, they cannot compensate for the negative effects of sedentary behavior.

The only remedy is to stand up regularly and occasionally work standing up. The FOPH therefore recommends that sedentary work be interrupted periodically. Employers should also become active: In the area of workplace health promotion, they should help to ensure that their employees move regularly and, for example, procure standing desks.

This is also supported by the National Program Nutrition and Physical Activity (NPEB), which will run until the end of 2016.
